With this car crash scenario, who would be at fault?
If you were pulling out onto a road and saw a bike coming at you, driving on the wrong side of the road, and you stopped and they hit your car, who would be at fault? the bike riders are on the wrong side of the road, going against traffic and didnt have helmets on. the car was stopped and a little over the white line.
who would be at fault? the person in the car or on the bike?
I'd say both. Even though the bike rider was on the wrong side of the road, the driver should have used due diligence and looked that way before pulling out. The bike rider could just as easily been a jogger who would have been legally on the proper side of the road.
